MON-PARIS: GENERAL TERMS AND CONDITIONS OF SALE

 

1)       RESERVATIONS

 

  1. Reservation of one of our apartments implies complete and unconditional acceptance by the client of MON-PARIS’s General Terms and Conditions, which the purchaser is deemed to have read. Any exception to these conditions granted by MON-PARIS for the client’s benefit in no way modifies the present terms and conditions. Complete or partial nullity of any clause in the General Terms and Conditions does not entail the nullity of the other terms and conditions.

  2. The General Terms and Conditions are annexed to the rental contract. Rental proposals are subject to availability.

  3. The initial payment and signed contract must reach MON-PARIS within 24 hours of receipt of MON-PARIS’s proposal. Reservations cannot be guaranteed beyond this limit.

  4. Reservations can only be accepted from clients aged 18 or over at the time of the reservation.

  5. Reservation is only final once MON-PARIS has received payment of the deposit.

 

2)       CONDITIONS OF PAYMENT

 

All prices are in euros.

 

  1. Conditions

Payment of the deposit:

Reservation and sale are final on reception by MON-PARIS of the signed contract and down payment of 25% of the total amount of all rental fees and services but remain subject to the continuing availability of the apartment.

Payment of the balance:

The balance of the rental cost must be paid on arrival at the apartment, otherwise the reservation will be cancelled and the deposit forfeited.

Payment of the security deposit

The security deposit must be paid on arrival at the apartment, otherwise the reservation will be cancelled and the deposit forfeited.

Keys

The keys to the rented apartment will only be entrusted to the client on payment to MON-PARIS of any outstanding fees for rental and services and also the specified security deposit.

 

b.       Methods of payment

Payment must be in euros.

Credit cards are not accepted.

Deposits may be paid by the following means:

-          Bank transfer

-          Cash

-          Postal money order

-          Travellers’ checks

The person in whose name the reservation is made is responsible for the payment of all rental costs and for compliance with all associated terms. He will also be held responsible for damage incurred by those sharing the apartment with him according to MON-PARIS’s General Terms and Conditions.

All bank charges must be paid by the client.

 

3)       SECURITY DEPOSIT

a.       The security deposit is required to cover any damage caused by the person or persons occupying the apartment.

b.       The security deposit will be returned to the client on the day of departure after deduction of any sums owed to the lessor. In the case of damage caused by the tenant and requiring the intervention of professional repairers, the security deposit will be retained for a maximum period of 30 days to enable estimates of costs to be obtained.

c.       If no check-out inventory is possible due to the client’s precipitated departure or to his departure outside normal office hours or for any other reason, the security deposit will be forwarded to the client after deduction of any sums due as specified above. In such cases it is the client’s responsibility to inform MON-PARIS of any reservations he may have concerning the damage report within 48 hours of receipt of the latter. Beyond this limit the check-out inventory will be considered final and the client will have no further right to contest any sums retained from the security deposit.

d.       The sum paid as a security deposit in no way limits the financial liability of the client, who remains responsible for the real cost of any damage caused in excess of the deposit paid. In the event of one of the apartment keys being lost or stolen, the locks will be changed at the client’s expense. The minimum amount payable for any loss, damage or deterioration to the property is 20€ per incident.

e.       MON-PARIS provides high-quality household linen in all its apartments and, in order to ensure the quality of this service, items of household linen missing at the time of the check-out inventory will be billed as follows:10€ per tea towel/dishtowel, 15€ per bath towel, 30€ per sheet or pillowcase and 50€ per duvet cover. These rates may vary according to the category of apartment rented, in which case prices will be indicated in the corresponding checklist.

 

 

4) PRICES & SERVICES

 

a.       Prices include:

-          Use of a furnished and fully-equipped apartment for the duration of the period specified in the rental agreement

-          Household linen

-          Crockery, cutlery and electrical household appliances

-          Cost of water and electricity

-          Real estate and residence taxes (for stays of less than 28 days)

-          Presence of MON-PARIS’s representative on arrival and departure for transfer of keys and other formalities

-          Household insurance covering the apartment but not the tenants or their personal belongings. MON-PARIS recommends that clients subscribe to supplementary personal insurance as appropriate

 

b.       Prices DO NOT include:

-          Cost of  telephone calls

-          Security deposit

-          Post-departure cleaning or any optional services not previously specified and billed

 

MON-PARIS tries to ensure that all descriptions and photographs are as representative as possible but these are not legally binding and MON-PARIS cannot accept responsibility for any subsequent changes made to its apartments.

 

5)       INSURANCE

-          The client should ensure that he and the persons accompanying him are covered by their own personal insurance with regard to personal injury or damage to property incurred during their stay.

-          The client acknowledges that the improper use of furnishings and appliances, particularly those in the kitchen and bathroom, may prove dangerous. The client and those accompanying him are fully responsible for taking all necessary precautions before using any appliance or equipment they are not familiar with.

-          The client recognizes that showers, bathtubs and floors may be slippery when wet and promises to remind his guests of this.

-          It is the client’s responsibility to take all necessary precautions to avoid any accident involving himself or his guests

-          By signing this contract, the client declares himself to be insured and agrees not to hold MON-PARIS responsible for any accident or injury incurred during his stay. 

 

6)       CANCELLATION & MODIFICATION OF CONTRACT

 

a.      BY THE CLIENT

 

Any request by the client to cancel or modify the rental agreement must be forwarded to MON-PARIS by e-mail and confirmed by registered letter with proof of reception according to the conditions mentioned below. Such modifications include:

-          Cancellation of reservation

-          Failure to be present at the date and time marking the beginning of the contract

-          Modification of dates of stay

-          Departure before the end of the contract

 

The time limits specified below are from the date of reception and do not include Sundays or French public holidays. Cancellation or modification of the agreement as specified above will entail minimum costs of:

 

-          50% of the deposit if requested more than 60 days before the beginning of the contract

-          100% of the deposit if requested less than 60 days before the beginning of the contract

 

b.      BY MON-PARIS

 

MON-PARIS reserves the right, under exceptional circumstances, for technical reasons or for reasons beyond its control, to replace the requested apartment with another of the same category or price. No reimbursement of fees can be considered unless MON-PARIS is unable to provide equivalent accommodation, and under no circumstances will any compensation be due in addition to the possible reimbursement of fees.

 

7)       ARRIVAL & DEPARTURE FORMALITIES

 

a.      On arrival

Unless agreed otherwise, check-in is possible daily from 3.30pm to 8pm.

As soon as he arrives in Paris the client is requested to fix an appointment with MON-PARIS’s representative at the apartment by calling one of the following numbers: +331 43 38 03 14 or +336 16 92 46 84. This call must be made at least one hour before arrival at the apartment. The reservation is thus confirmed for a temporary or seasonal furnished rental agreement. On arrival at the apartment the client will check the inventory and compliance with the accommodation description before signing the rental agreement and paying the outstanding balance of the rental fee together with the security deposit. He will then be given the keys to the apartment.

 

b.      On departure

Unless agreed otherwise, the apartment must be vacated before 11am and an appointment should be made with MON-PARIS’s representative between 8am and 11am to complete departure formalities (checking of inventory and the general condition of the apartment, returning of keys and reimbursement of the security deposit if no damage is recorded).

 

8)       RESPONSIBIITIES

a.      The client’s responsibilities

-          For reasons of hygiene, pets are not permitted in MON-PARIS’s apartments unless specified in writing by MON-PARIS.

-          MON-PARIS provides accommodation in a fully furnished and equipped apartment and the client is responsible for any deterioration of the apartment or furnishings during the rental period.

-          Repair costs will be deducted from the security deposit and the client billed for any costs in excess of that sum.

-          All rental properties are non-smoking and any cigarette burns, however slight, will result in the deduction of a minimum of 180€ from the security deposit.

-          MON-PARIS can accept no responsibility whatsoever for the loss, deterioration or theft of the client’s personal effects or of those of his guests or any other third party. This disclaimer includes any valuables left unsupervised in the apartment, even if the client is present. The client must take all reasonable precautions, such as closing and locking all doors and windows on leaving the apartment, in order to prevent any intrusion.

-          The client is fully responsible for any damage and the consequences thereof, whether direct or indirect and including bodily harm, which may occur in the apartment or the communal areas of the building and affect himself or a third party as a result of any act or omission or negligence on his part or on that of one of his guests.

-          The client and any third party involved expressly renounce the right to sue MON-PARIS for any damage, injury or other bodily harm that may occur. Should the client or any of his guests wish to take legal action against a third party, they agree to assume full responsibility for doing so.

-          The client must respect the rules and regulations applicable in the building in which his accommodation is situated: he must not be the source of excessive noise or other disruption which might disturb the other occupants of the building and he must respect regulations concerning the use of the communal areas of the building.

-          The client agrees not to engage in any illegal, illicit, immoral or business-related activity within the apartment or on the premises. Sub-letting of the apartment is strictly forbidden.

-          On departure, the client must leave the apartment as clean and orderly as it was on his arrival. If additional cleaning is required on the client’s departure, this will be billed to the client at a rate of 25€ per hour and for a minimum of two hours.

-          It is forbidden to fix objects to the walls and to displace furniture and appliances.

-          Accommodation is provided for the sole purpose of tourism and any commercial use of the property is strictly forbidden. The client certifies that he is renting the property for the purpose of tourism only and under no circumstances may he establish residence at that address.

-          MON-PARIS reserves the right to enter the premises at any time to ensure essential maintenance and security.

-          The above are essential terms and conditions without which MON-PARIS will not enter into a rental agreement.

 

The client acknowledges that any violation of the above conditions will lead to immediate termination of the rental agreement and that he will be required to vacate the premises immediately and with no compensation whatsoever.  

 

b.      MON-PARIS’s responsibilities

 

-          Provision of a fully furnished apartment in good condition and working order

-          MON-PARIS cannot be held responsible for cancellations or delays in rental due to circumstances beyond its control, such as political or religious events, acts of war or of terrorism, natural disasters, fires, accidents, government decisions, strikes or other forms of industrial action.

-          MON-PARIS cannot be held responsible for mechanical failure of equipment in the apartment or block (elevators, electric doors, heating, TV antenna, etc.) or for the breakdown of services such as gas, electricity, water, cable TV or Internet.

-          The information provided by MON-PARIS is from sources deemed reliable but MON-PARIS cannot guarantee its accuracy and it is submitted subject to errors, omissions and subsequent changes.

 

9)       LITIGATION

 

The rental agreement, its annexes and the present General Terms and Conditions list the conditions agreed to by the contracting parties. By signing this agreement, the client accepts these conditions without reserve. If one of the clauses should be declared null and void by court decision, the remaining clauses would continue to be applicable.

In the event of legal proceedings being engaged by either party, only French law and the French versions of the documents will be take into account. In the case of such proceedings relative to the execution of the General Terms and Conditions, the conditions in which they are executed or the consequences of their execution, and if no amicable settlement can be reached between the parties so that the case must be brought before the courts, the parties agree to give jurisdiction to the Tribunal de Paris (Paris Law Court).

 

10)   PROPERTY OF MON-PARIS

 

The photographs made available on the MON-PARIS website are not legally binding and may not be used without the written permission of MON-PARIS. Failure to respect this condition may lead to the taking of legal action by MON-PARIS.
